ممارسة نشاط التأمين التكافلي في الجزائر بين تخصيص نافذة وتأسيس شركة

Résumé: يتناول هذا البحث قراءة في جانب من جوانب أحكام المرسوم التنفيذي رقم 21-81 المحدد لشروط وكيفيات ممارسة التأمين التكافلي في الجزائر، والمتعلقة بكيفية تقديم خدمات التأمين التكافلي للجمهور، أين يتم ذلك إما عن طريق تأسيس شركة تأمين متخصصة في تقديم خدمات التأمين التكافلي، أو من خلال تنظيم داخلي يسمى "نافذة" يسمح من خلاله لشركة تأمين تقليدي تقديم خدمات التأمين التكافلي إلى جانب خدمات التأمين التقليدي مع وجوب الفصل التام بينهما. ويقتضي ممارسة هذا النشاط وفق هذا الشكل أو ذاك، وجوب توفر بعض الشروط المحددة بموجب النصوص القانونية والتنظيمية، كما يترتب عن ذلك عدة آثار، أملا في انتشار وتطور هذا الصنف من الخدمات التي تتوافق مع مبادئ الشريعة الإسلامية. This research examines some of the provisions of Executive Decree No. 21-81 establishing the conditions and modalities for the practice of takaful insurance in Algeria, concerning how to provide takaful insurance services to the public, where this is done either through the establishment of an insurance company specializing in the provision of takaful insurance services, or through an internal organization called A "window" through which a traditional insurance company is permitted to provide symbiotic insurance services along with traditional insurance services and must be completely separated. The practice of this activity in one form or another requires that certain conditions prescribed by the legal and regulatory provisions, as well as several implications, be met in the hope of the proliferation and development of this type of service that conforms to the principles of the Islamic sharia.
