الحماية الإدارية للتراث الثقافي في التشريع الجزائري

Résumé: يعد التراث الثقافي مصدر افتخار الأمم والشعوب والدول، فهوحلقة الوصل بين مكونات الأصالة والهوية الوطنية والانتماء الحضاري الذي يرتبط بشخصيتها ويمنحها الطابع الذي يميزها عن غيرها. ولهذا فإن حماية التراث الثقافي مهمة كبيرة تحتاج إلى آليات ووسائل من خلال وضع تشريع داخلي يساهم بشكل فعال في حمايته واستدامته، وتعتبر الجزائر من بين الدول الغنية بثروة ثقافية هائلة خلفتها حضارات عديدة، لذلك وضع المشرع الجزائري إطار قانوني ينظم هاته الآليات ويعنى بصونه والحفاظ عليه. ويتجلى ذلك من خلال مختلف الأنظمة القانونية والأجهزة والوسائل الإدارية الفاعلة في حماية التراث الثقافي مع التنويه إلى أن رقمنة التراث الثقافيفي ظل تحديات العولمة تعتبر من أنجعالآليات التي تحقق استدامة فعلية للموروث الثقافي قد تضمن مكاسب للأجيال القادمة. الكلمات المفتاحية: التراث الثقافي، مخططات الحماية، الضبط الإداري، رقمنة التراث. Abstract Cultural heritage is a source of pride for nations, peoples and countries, as it is the link between the components of authenticity, national identity and civilizational affiliation that is linked to their personality and gives them the character that distinguishes them from others. Therefore, the protection of cultural heritage is a great task that needs mechanisms and means through the development of internal legislation that contributes effectively to its protection and sustainability, and Algeria is among the rich countries with a huge cultural wealth left by many civilizations, so the Algerian legislator has developed a legal framework that regulates these mechanisms and is concerned with its preservation and preservation. This is evident through the various legal systems, agencies and administrative means effective in protecting cultural heritage, noting that the digitization of cultural heritage in light of the challenges of globalization is one of the most effective mechanisms that achieve actual sustainability of cultural heritage that may guarantee gains for future generations.
