الدور الرقابي للمراقب المالي
Résumé: تتعلق المهام التي يقوم بها المراقب بتنفيذ الرقابة المسبقة على النفقات العامة في ظل احترام المرجعية القانونية والمالية المتعلقة بتنفيذ هذه النفقات العامة، لذا تهدف دراستنا لهذا الموضوع إلى التعرف على المراقب كجهة مختصة لهذه الرقابة وكذلك النفقات التي تخضع للرقابة للوصول إلى بيان وإبراز الدور الرقابي والمحوري للمراقب. وتوصلت هذه الدراسة إلى أن رقابة المراقب تضمن مشروعية النفقات العامة، وليس ملاءمتها، فإما منح التأشيرة على مشروع الالتزام أو مذكرة الرفض المؤقت أو النهائي، مع إمكانية استخدام وسيلة قانونية للتغاضي في حالة استمرار تنفيذ النفقات العامة.The tasks performed by the controller relate to the implementation of prior control of public expenditures in light of respect for the legal and financial reference related to the implementation of these public expenditures, so our study of this topic aims to identify the controller as a competent body for this control, as well as the expenses that are subject to control to reach a statement and highlight the supervisory and pivotal role of the controller. This study found that the controller's control guarantees the legality of public expenditures, not their appropriateness, so either a visa is granted on the draft commitment or a temporary or final rejection note, with the possibility of using a legal means of condoning in the event of continued implementation of public expenditures.
