التقاضي الالكتروني ومدى فعاليته في النظام القضائي الجزائري

Résumé: إن ثورة الاتصالات وتكنولوجيا المعلومات التي يعيشها العالم أدت الى وجود طرق جديدة للتعامل والإتصال، وكان لها أثر كبير على مختلف المجالات في الجزائر، من بينها مجال القضاء والذي عرف تغييرا من خلال عصرنة النظام القضائي الجزائري وتبني ما يسمى التقاضي الالكتروني. وعليه، تهدف هذه الدراسة إلى تبيان مفهوم التقاضي الالكتروني وكذا إيجابياته وسلبياته، بالإضافة الى الصعوبات التي تعترض تطبيقه. أين تم التوصل إلى أن للتقاضي الالكتروني ايجابيات كثيرة أبرزها اختصار الوقت والجهد، إلا أنه يصطدم بعدة عوائق تحد من فعاليته ونجاحه في الجزائر. الكلمات المفتاحية: التقاضي الالكتروني- عصرنة-عدالة-فعالية. Abstract: The revolution of communications and information technologies that the world is experiencing has led to theexistence of new modes of processing and communication, and it has had a great impact on various fields in Algeria, including the field of justice, which has undergone a change through the modernization of the Algerian judicial system and the adoption of so-called electronic litigation. Thus, this article aims to clarify the concept of electronic litigation as well as its advantages and disadvantages, in addition to the difficulties encountered in its application. Where was it concluded that electronic litigation has many advantages, including shortening of time and effort, but it faces several obstacles that limit its effectiveness and success in Algeria. key words: electronic litigation-modernization- justice-effectiveness-difficulties.
