من المصرفية التقليدية إلى المصرفية الإسلامية- متطلبات وآليات التحول

Résumé: یأتي هذا البحث لیغطي جانباً مهماً في موضوع تحول المصارف التقلیدیة للعمل وفق أحكام الشریعة الإسلامیة، عن طریق ذكر أھم الإجراءات الفعلیة الشرعیة والتنظیمیة، وكیفیة تطبیق هذا التحول على بعض المعاملات المالیة المعاصرة، لذا فان مثل هذه الدراسة تركز على آليات ومتطلبات التحول من المصرفية التقليدية إلى المصرفية الإسلامية وأهم الضوابط والمتطلبات والأدوات والأساليب المطلوبة لتبني هذه الخدمات. وقد سلكت في هذا البحث المنهج الاستقرائي التحلیلي المقارن، وخلصت إلى عدة نتائج منها: أن تحول المصارف التقليدية للمصرفية الإسلامية أمر واجب شرعا، وأسلوب التدرج يعتبر من أنجح الأساليب المتبعة في تنفيذ التحول، كما أن توفر الموارد البشرية المؤهلة من أهم متطلبات التحول للمصرفية الإسلامية، ویتوجب على المصرف الذي قرر التحول القیام بإجراءات تنظیمیة داخل المصرف تتمثل في اتخاذ قرارات إداریة في هيكلة عمله، وإنشاء هيئة للفتوى والرقابة الشرعیة فيه، مع أن تحول المصارف التقليدية للمصرفية الإسلامية يساهم بشكل فعال في تطوير صيغ وأساليب استقطاب الأموال وتشغيلها. The research covers a significant aspect of the tradition hanks’ transformation to practice banking according to Sharria rulings. By citing the most important measures the actual legitimacy and regulatory , and how to apply this transformation on some contemporary financial transactions, therefore, such a study focusing on the requirements of the shift from conventional banking to Islamic banking mechanisms and the most important controls and requirements and tools and techniques required to adopt these services. The walk in this research inductive comparative analytical and concluded several conclusions, including: The transformation of traditional banks, Islamic banking is a must religiously , style gradient is one of the most successful methods used in the implementation of the transformation , and the availability of qualified human resources of the most important transformation requirements of Islamic banking , the seller bank decided to shift do regulatory action within the Bank is to take administrative decisions in restructuring work, and the creation of a body for fatwa and Sharia Supervisory Board which, with conventional banks and Islamic banking turned contribute effectively to the development of formats and methods of attracting money and run .
