الضبط الإداري بين قدر كورونا وحرية الأفراد

Résumé: تعرضت الجزائر كغيرها من الدول للفحات قاتلة من وباء كوفيد 19 وأمام عجز أعنى المنظموات الصحية في إيجاد برتوكول صحي إتجهت الجزائر نحو الخيار الوقائي بالعمل على محاصرة الوباء والتقليص من آثاره على الصحة العمومية فتم ترجمة هذا التوجة ، في تفعيل سلطات الضبط الإداري وتحيينها فتجندت معها مراسيم تنظيمية وقرارات فردية وصولا إلى تسخير القوة العمومية ، إلا أن الصعوبة تكمن في توفيق سلطات الضبط الإداري بين مقاصد الصحة العمومية و حرية الأفراد، و لذلك اتجه بعض الفقه القانوني إلى إعفاء سلطات الضبط الإداري من بعض ضوابط المشروعية وفسر ذلك بأن التعامل مع وباء كورونا هو تعامل مع ظروف استثنائية . ذ Algeria, like other countries, was subjected to fatal blows from the epidemic of Kovid 19, and before the inability of the health organizations to find a healthy protocol, Algeria went towards a preventive option by working to besiege the epidemic and reducing its effects on public health.
