دور الاجتهاد القضائي في تعزيز الحماية القانونية لحقوق الملكية الصناعية والتجارية في الجزائر

Résumé: تنقسم الملكية الصناعية والتجارية إلى ابتكارات صناعية منها ما هو نفعي كبراءة الإختراع، والآخر جمالي كالرسوم والنماذج الصناعية، وهذا هو معيار التفرقة بينهما، ففي الوقت الذي تمنح براءة الإختراع مكافأة لمبتكري المنتجات والعمليات الجديدة، يشجع قانون الرسوم والنماذج الصناعية العرض الجديد لمنتجات معروفة. كما ظهرت في الآونة الأخيرة إبتكارات مرتبطة بالجانب الإلكتروني، تصنف الدول على أساسها إلى متقدمة ومتخلفة، لهذا أصبحت تسترعي اهتمام الباحثين والفقهاء وحتى العاملين في المجال الإلكتروني، وهي ما اتفق على تسميته التصاميم الشكلية للدوائر المتكاملة. وإلى شارات مميزة تتضمن العلامة التجارية، الإسم والعنوان التجاريين، وتسمية المنشأ. ولا مجال للحديث عن حماية هذه الحقوق الصناعية دون اللجوء الفعلي للحماية القضائية ودون التأسيس النظري والعلمي للدور الإيجابي للقضاء في صيانة وتفعيل حقوق صاحب هذه الأصول الصناعية، وذلك بأقرب الطرق القضائية وبأبسط الإجراءات وبأقل المصاريف، لذا فإن الخوض في الحماية القضائية في حد ذاته موضوع حديث النشأة نسبيا، وقد دعا إلى الإهتمام به أكثر التطور الإقتصادي الكبير خاصة مع سياسة الانفتاح الإقتصادي، وخاصة في غياب النصوص القانونية في بعض الحالات، في ضوء المفاهيم المختلفة والمبادئ القانونية، وفي كل قضية من القضايا التي تعرض على المحاكم الأمر الذي يتطلب اجتهاد القاضي لإيجاد حل في موضوع النزاع المطروح أمامه. يتضح مما تقدم الدور الجوهري الذي يلعبه الإجتهاد القضائي في توفير الحماية اللازمة لحقوق الملكية الصناعية في حالة غياب النصوص القانونية في بعض المسائل، وعليه يمكن طرح التساؤل التالي: إلى أي مدى يساعد الإجتهاد القضائي في تعزيز الحماية القانونية للملكية الصناعية في الجزائر؟ Abstract Industrial and commercial property is divided into industrial inventions, such as the patent of invention, and aesthetic, such as industrial designs, This is the criterion for distinguishing them. Recent inventions related to the electronic aspect have also appeared, on the basis of which States are classified as developed or underdeveloped, thus attracting the attention of researchers, academics and even workers in the field of electronics, which have been agreed to be referred to as integrated circuit layout-design (topographies) and distinctive badges, including trade name, business address and designation of origin. There can be no question of protecting these industrial rights without the effective use of judicial protection and without the theoretical and scientific establishment of the positive role of justice in the maintenance and implementation of the rights of the owner of these assets industrial. This is a particularly interesting subject, particularly as regards the policy of economic openness. In particular, in the absence of legal texts in certain cases, in the light of different legal concepts and principles, and in each case before the courts, the jurisprudence of the judge is necessary to resolve the subject matter of the dispute. It follows from the above that case law plays an essential role in ensuring the necessary protection of industrial property rights. And the question when can ask: To what extent does the jurisprudence strengthen the legal protection of industrial property in Algeria.
