خصوصية التجريم والعقاب في جرائم عصابات الأحياء

Résumé: نظرا لما نجم عن عصابات الأحياء من إنعدام الأمن في أوساط الأحياء السكنية بسبب عجز السلطات المختصة عن احتوائها نظرا لأن التشريع الوطني الساري المفعول لا يغطي جميع أشكال جرائمهم، الأمر الذي أدى إلى إصدار الأمر 20/03 المتعلق بالوقاية من عصابات الأحياء ومكافحتها، حيث تضمن هذا الأخير مجموعة من الخصوصيات تنفرد بها جرائم عصابات الأحياء، ولقد طرحت هذه الورقة البحثية إشكالية هل السياسة الجزائية الحديثة للمشرع الجزائري إزاء جرائم عصابات الأحياء كانت كفيلة بالحد منها؟ وللإجابة على هذه الإشكالية تضمنت الدراسة قراءة في النصوص الواردة في الأمر والمتعلقة بالتجريم والعقاب، كل ذلك بهدف التوصل إلى مدى فعالية الاستيراتيجية الجنائية التي وضعها المشرع للتقليل من جرائم عصابات الأحياء ومنع انتشارها. As a consequence of the insecurity caused by gangs in residential neighborhoods due to the inability of the competent authorities to contain them, given that the national legislation in force does not cover all forms of their crimes, which led to the issuance of Order 20/03 related to the prevention and control of neighborhood gangs, which included this The latter is a set of peculiarities that are unique to the crimes of neighborhood gangs. This research paper questions does the Algerian legislature's modern penal policy on the crimes of neighbourhood gangs have the potential to reduce them? In order to answer this question, the study included a reading of the texts contained in the order related to criminalization and punishment, all with the aim of reaching the extent of the effectiveness of the criminal strategy developed by the legislator to reduce the crimes of neighborhood gangs and prevent their spread.
