حقوق الإنسان في ظل دستور 2020 وضمانات حمايتها

Résumé: إن تكريس الحقوق و الحريات في الدستور هو عماد الحكم العادل الذي تستمد منه اي سلطة شرعيتها بعد الانتخاب عليها بطريقة ديموقراطية، وهو مقياس للعدالة و الديموقراطية وتعزيز دولة القانون و المؤسسات، ولطالما كانت الحقوق والحريات عبر الدساتير الجزائرية المتعاقبة رهينة التوجه السياسي للدولة، فالمشكلة التي يطرحها موضوع حقوق الإنسان و الحريات العامة لا تختصر بمسألة الاعتراف بالحقوق و الحريات العامة او عدم الاعتراف بها، بل انها تتعلق أساسا بمسألة تنظيم ممارسة الحقوق والحريات العامة وحمايتها ميدانيا وإحاطتها بالضمانات الدستورية و القانونية. لقد اهتم دستور 2020 بالحقوق و الحريات الأساسية سواء كانت سياسية او اقتصادية او اجتماعية أو دينية، كما افرد لها بشكل مفصل وموسع بابا خاصا سماه الحقوق الأساسية و الحريات العامة، و الذي جاء بمجموعة من المبادئ و الأحكام تكرس دولة القانون و التداول على السلطة وأخلقه الحياة السياسية وتعزيز الحقوق و الحريات ومكافحة الفساد. The consolidation of rights and freedoms in the constitution is the mainstay of just governance from which any authority derives its legitimacy after being elected in a democratic way, and it is a measure of justice and democracy and the strengthening of the rule of law and institutions. The issue of human rights and public freedoms is not limited to the issue of recognizing or not recognizing public rights and freedoms. Rather, it relates primarily to the issue of regulating the practice of public freedoms, protecting them on the ground and enclosing them with guarantees. Among the most prominent of these constitutional guarantees The 2020 Constitution was concerned with basic rights and freedoms, whether political, economic, social or religious, as it dedicated to them in a detailed and extensive manner a special chapter called Fundamental Rights, Public Freedoms and Duties, which came with a set of principles and provisions that enshrine the rule of law and the circulation of power. And the creation of political life, the promotion of rights and freedoms and the fight against corruption.
