البُعد الدِّيني لِلمُعاهدَات والمواثيقُ الدَّوليَّة في المنظور الحضاري الإسْلامي
Résumé: ملخص: كثيرا ما نجد أنفسنا، أمام مجموعة من التساؤلات حول القدسية الدّينية التي يضفيها التصور الحضاري الإسلامي على المعاهدات والمواثيق الدّولية، إلى الحد الذّي يمنحها حصانة أخلاقية بشكل منقطع النظير، ولعل هذا ما يستلزم أن تتصدر له عديد الأقلام الجادة حتى تزيد مثل هذه المساحات إشراقا فقد تساعد بذلك الباحثين والقراء في إنارة دروب جديدة من البحث والتمحيص..وفي هذا السياق تأتي هذه المقالة، كمحاولة لتبيان أهم الضوابط والأحكام الشرعية التي تنظم المعاهدات والمواثيق الدّولية وفق التصور الحضاري الإسلامي. كلمات مفتاحية: البعد الديني/المعاهدات/المواثيق الدولية/المنظور الحضاري تصنيف JEL : XN2، XN1. Abstract: We often find ourselves faced with a series of questions about the religious sanctity that Islamic civilization confers on international treaties and charters, inasmuch as it confers upon it unprecedented immunity, and perhaps this may require that the number of serious pens to increase these brighter spaces In this context, this article attempts to illustrate the most important rules and regulations governing international treaties and charters according to the Islamic civilization concept.
