الرقابة الإدارية على الممارسات التعسفية في التشريع الجزائري

Résumé: ملخص: وضع المشرع الجزائري آليات عديدة للحد من ظاهرة الشروط في الممارسات التي يلجأ إليها الأعوان الاقتصاديون في علاقاتهم التعاقدية مع طائفة المستهلكين طلبا للربح بكل الوسائل، فضلا عن الأحكام العامة التي تضمنها القانون المدني، من بين تلك الآليات: الأجهزة الإدارية لفرض الرقابة اللازمة سواء قبل التعاقد أو بعده، وذلك لحماية المستهلك المتعاقد من تعسف العون الاقتصادي من خلال الرقابة الإدارية بموجب القانون 04-02 والمرسوم التنفيذي رقم 06-306، تهدف هذه الدراسة للوقوف على مدى نجاعة الدور الذي أناطه المشرع الجزائري بالأجهزة الإدارية للحد من الشروط التعسفية في العلاقات التعاقدية للأعوان الاقتصاديين مع المستهلكين. Abstract: The Algerian legislator set several devices to end the phenomenon of abusive clauses which are used by economic agents in their contract relations with consumers seeking profit with any available means and among these devices the administrative systems to impose the needed control either before or after the contract for the purpose of protecting the consumer from the economic agent. The Algerian legislator didn't only focus on the general laws found in the civil law, but tried to guarantee a protection for the consumer from being abused by the economic agent and which might be included within the administrative censorship according to 04-02 law and the executive decree 06-306. The present study aims to examine to what extent the success of the role of the Algerian legislator in minimizing abusive clause in contract relations of economic agents with consumers.
