نظام المناصفة كبديل لنظام الكوتا لتعزيز المشاركة السياسية للمرأة على مستوى المجالس المنتخبة The Parity System As An Alternative To The Quota System To Promote Women's Political Participation At The Level Of Elected Councils

Résumé: يشكل العمل السياسي للمرأة مظهرا من مظاهر تكريس الديمقراطية والحداثة السياسية ومقوماتها، ومحورا من المحاور الاساسية التي تبناها المؤسس الدستوري انطلاقا من التعديل الدستوري لـسنة 2008 الذي شكل محطة بارزة للارتقاء بالحقوق السياسية للمرأة، وتعزيز حظوظ تمثيلها على مستوى المجالس المنتخبة وذلك بمقتضى المادة 31 مكرّر، وهو ما انعكس في القانون العضوي رقم 12ـ03، المحدّد لكيفية توسيع حظوظ المرأة في المشاركة السياسية، ودعمه التعديل الدستوري لسنة 2016، وهو المكسب الذي تم إسقاطه في ظل التعديل الدستوري الأخير لـ 2020، وكرسه تبعا لذلك الأمر رقم 21ـ01 المتضمن القانون العضوي للانتخابات المعدل، ليتم تعويضه بنظام المناصفة باعتباره أكثر نجاعة للارتقاء بالدور السياسي للمرأة، والانتقال بها من مجرد شريك شكلي إلى شريك فعال في صناعة القرار. Women’s political work constitutes a framework for the consolidation of democracy and political modernity and its components, and one of the main axes adopted by the constitutional founder based on the constitutional amendment of 2008, which constituted a prominent station to advance women’s political rights and enhance the chances of their representation at the level of elected councils, in accordance with Article 31 bis, which was reflected In Organic Law No. 12-03, which specifies how to expand women’s opportunities in political participation, and was supported by the 2016 constitutional amendment, a gain that was dropped in light of the last constitutional amendment of 2020, and accordingly dedicated Order No. 21-01 containing the amended Organic Law for Elections, to be compensated by a parity system. As it is more effective in upgrading the political role of women, and moving them from a mere formal partner to an effective partner in decision-making.
