Résumé: تعتبر " الرقابة الشرعية المتخصصة" من بين الأدوات الرقابية المستحدثة في العمل البنكي، و ترد أصولها للنظام المالي الإسلامي، و هي إحدى الخاصات الذاتية المميزة للنظام الإسلامي و أكثرها خطورة على نجاح المؤسسة المالية أو إخفاقها، و تتميز هذه الرقابة من حيث كونها ذات وظائف متعددة فهي لا تقف فقط عند ضبط أنشطة المصرف من الناحية الشرعية و الناحية التقنية المالية، و لكن دورها إسهامي أيضا استجابة للمتطلبات المستجدة حيث تعمل على تقديم البدائل الشرعية لإثراء العمل البنكي الإسلامي، و تنمية الوعي المصرفي لدى العاملين و العملاء و الأفراد، و لأجل تلك المقاصد الشرعية أسند لجهاز أو لهيئة الشرعية " هيئة الفتوى" متخصصة "وظيفة الرقابة" يمارسها بكل استقلالية مستمدا أحكامها من النص المنشئ في النظام التأسيسي للمصرف، و في ذات الوقت ملتزما بالمحددات و الضوابط و المعايير المنصوص عليها في التنظيمات ذات الصلة بقانون تأسيس المصرف و تنظيم عمله.
