الجريمة الإلكترونية بُعدٌ جديد للإجرام في الجزائر .. واقعها وآليات مجابهتها

Résumé: تتمحور هذه الورقة البحثية حول واقع الجريمة الإلكترونية في الجزائر، ومجهودات الدولة الجزائرية للتصدّي لهذا البعد الجديد للإجرام من خلال مرتكزين أساسين وهما الجانب التشريعي الذي عرف تعديلات كثيرة على القوانين ذات العلاقة بالمجال الإلكتروني وأهمها قانون العقوبات وقانون الإجراءات الجزائية، إضافة إلى سنّ حزمة جديدة من القوانين تتماشى مع التطورات التي تشهدها الجريمة الإلكترونية وأهمها قانون 09-04 المتضمّن القواعد الخاصة للوقاية من الجرائم المتصلة بتكنولوجيات الإعلام والاتصال ومكافحتها. و الجانب المؤسّساتي من خلال استحداث وإنشاء مراكز ومصالح مختصة في محاربة الجريمة الإلكترونية ومواجهتها على غرار المصلحة المركزية لمكافحة الجريمة المعلوماتية التابعة لمديرية الأمن الوطني، المعهد الوطني للأدلة الجنائية وعلم الإجرام للدرك الوطني، مركز الوقاية من جرائم الإعلام الآلي والجرائم المعلوماتية للدرك الوطني و الهيئة الوطنية للوقاية من الجرائم المتصلة بتكنولوجيات الإعلام والاتصال ومكافحتها بالإضافة إلى القطب الجزائي الوطني لمكافحة الجرائم المتصلة بتكنولوجيات الإعلام والاتصال This research paper focused on the reality of cybercrime in Algeria, and the efforts of Algerian State to address this new dimension of crime through two main pillars, namely the legislative aspect, by introducing amendments to the laws related to the cyberspace, the most important of which are the Penal Code and the Code of Criminal Procedure, as well as by enacting a new package of laws in line with developments in cybercrime, the most important of which is Act No. 09-04 containing special rules for the prevention and control of crimes related to information and communication technologies. On the institutional side, the National Gendarmerie Institute for Forensic Evidence and Criminology, the National Gendarmerie Center for the Prevention of Computer Media and Cybercrime, the National Commission for the Prevention and Control of Crimes Related to Information and Communication Technologies and the National Penal Pole for the Fight against Crimes Related to Information and Communication Technologies, have established specialized centers and departments for combating cybercrime.
