الإنهاء التام للعلاقة الوظيفية من غير تأديب. Complete Termination Of The Employment Relationship Without Discipline.

Résumé: The legislation regulating the public service in Algeria relied on Ordinance 06-03 in determining the employee’s relationship with the public administration on the basic legal relationship in the text of Article 07 of it. Therefore, the reasons for the complete termination of the employment relationship without discipline are subject to the text of Article 216 of Ordinance 06-03, which are: loss of Algerian nationality or deprivation of it, loss of civil rights, legally accepted resignation, retirement, death, and therefore disciplinary reasons are excluded from this study, They are dismissal and dismissal, and as a result of all these reasons, the job relationship is terminated and the job relationship is cut off and the consequent loss of the capacity of the public servant. اعتمد التشريع المنظم للوظيفة العمومية في الجزائر الأمر06-03 في تحديد علاقة الموظف بالإدارة العمومية على العلاقة القانونية الأساسية في نص المادة 07 منه، وهذا معناه أن أي تصرف من طرفي العلاقة ينبغي أن يستند للنص القانوني سواء عند دخول الموظف العمومي للوظيفة العمومية أو خروجه منها مرورا بالتكوين وتحسين المستوى والترقية والتأديب. ولهذا فإن أسباب الإنهاء التام للعلاقة الوظيفية من غير تأديب تخضع لنص المادة 216 من الأمر 06-03 وهي: فقدان الجنسية الجزائرية أو التجريد منها، فقدان الحقوق المدنية، الاستقالة المقبولة بصفة قانونية، الإحالة على التقاعد، الوفاة، وبالتالي يستبعد من هذه الدراسة الأسباب التأديبية وهي العزل، والتسريح، ونتيجة لكل هذه الأسباب تنقضي وتنقطع العلاقة الوظيفية وما يترتب عن ذلك من فقدان صفة الموظف العمومي.
