رقابة مجلس المنافسة لعمليات التجميع الاقتصادي

Résumé: تعتبر عمليات التجميع الاقتصادي عنصرا أساسيا في تحريك ديناميكية الاقتصاد الوطني وتمكينه من مواجهة تحديات المنافسة الأجنبية، إلا أنه وحفاظا على توفير جو تنافسي داخل السوق الوطني أخضع المشرع هذه العمليات لرقابة مجلس المنافسة متى حصلت وضعية هيمنة، فيتم الترخيص بالتجميع إذا كان لا يشكل خطورة على السوق، وبالعكس يرفض الترخيص إذا كانت العملية تؤدي إلى المساس بالمنافسة. ومن جهة أخرى، تتدخل الدولة في مراقبة عمليات التجميع الاقتصادي، حيث يجوز للحكومة استصدار ترخيص لدواعي المصلحة العامة رغم رفض مجلس المنافسة لمشروع التجميع المرفوع إليه، الأمر الذي يهدف إلى زيادة الفعالية الاقتصادية وتحسين الظروف المعيشية للمستهلكين، وباعتبار مجلس المنافسة سلطة إدارية يمكن الطعن في قراراته المتعلقة بالتجميعات الاقتصادية أمام مجلس الدولة. On the other hand, the state intervenes with the control of economic concentration operations, where the Government may issue a license for the public interest, despite the Competition Council refused of the concentration project submitted to it, Which aims to increase economic efficiency and improving living conditions for consumers, As the Competition Council is an administrative authority, its decisions relating to economic concentrations can be appealed before the State Council.
