Résumé: تزامنا مع الثورة المعلوماتية والتطور التكنولوجي الذي شهدته جميع نواحي الحياة، وما تميزت به الوسائل التكنولوجية المتطورة، من قدرة هائلة في تجميع ومعالجة وتبادل المعلومات، والاعتماد المتزايد على تلك الوسائل ، أدى الى ظهور إشكالات حماية حقوق المبدعين عبر النت و اصبحنا امام عصر جديد لحقوق المؤلف ، لم يعد فيه نظام المؤلف كفيل بحماية حقوق المؤلفين في البيئة الرقمية ، ما جعل البعض يشدد الحماية سواء أكانت قانونية légal أم تقنية technological ، وآخر يحاول إيجاد نظم وبدائل لحقوق الملكية الفكرية و اعتبارها قيد للإبداع و التشاركية الفكرية ، ما بين مؤيد للإبقاء على النظام وملائمته ومعارض له باعتباره عائق امام التشاركية الفكرية للجمهور تقف ورقتنا البحثية لتسليط الضوء على هذه الاتجاهات و توضيح الرؤى In conjunction with the information revolution and the technological development witnessed by all aspects of life, and what was characterized by the advanced technological means, the enormous capacity in collecting, processing and exchanging information, and the increasing reliance on these means, has led to the emergence of problems protecting the rights of creators across the Internet and we are facing a new era of copyright.
