الوكالة في الزكاة وأحكامها في الفقه الإسلامي
Résumé: يهدف البحث إلى بيان مفهوم الوكالة في الزكاة وأنواعها وشروطها وأحكامها؛ حيث تناول الفقهاء الوكالة في فقه المعاملات والزكاة في فقه العبادات، لكن قلة منهم تناول الموضوع المبحوث. وتوصل البحث إلى نتائج هامة، منها: جواز الوكالة على الزكاة دفعا وقبضا، عدم جواز أخذ الوكيل من الزكاة إلا بإذن الموكل، وعدم جواز توكيل الوكيل لوكيل آخر على الزكاة إلا بإذن الموكل، عدم ضمان الوكيل إذا تلفت الزكاة في يده من غير تقصير منه. Abstract: The research aims to clarify the concept of agency in Zakat, its types, terms and conditions; Where the jurists dealt with agency in the jurisprudence of transactions and zakat in the jurisprudence of worship, but few of them dealt with the subject under investigation. The research reached important results, including: the agency’s permissibility of zakat payments and receipts, the inadmissibility of the agent taking zakat from zakat except with the permission of the client, and the inadmissibility of the agent assigning another agent to zakat without the permission of the client, the lack of guarantee for the agent if the zakat is destroyed in his hand without shortcoming from him.
