- أثر فقه الموازنات في القتل الرحيم -رفع أجهزة الإنعاش عن الميت دماغيا أنموذجا
Résumé: هذا المقال محاولة لبيان جانب من جوانب الأحكام الشرعية المتعلقة بالمسائل الطبية من منظور فقه الموازنات، ويتعلق الأمر بأثر فقه الموازنات في حكم رفع أجهزة الإنعاش عن الميت دماغيا، تناولت فيه أولا ماهية فقه الموازنات، وذلك من خلال بيان تعريف فقه الموازنات وأهميته وأهم أنواعه، ثم عرضت ثانيا لبيان ماهية الموت الدماغي، وتطرقت في الأخير إلى أثر الموازنة في حكم رفع أجهزة الإنعاش عن المتوفى دماغيا، وقد خلصت الدراسة إلى وجوب إعمال فقه الموازنات في حالات الموتى دماغيا لتحديد حاجتهم لأجهزة الإنعاش من عدمها. This article is an attempt to clarify an aspect of the legal rulings related to medical issues from the perspective of the balance jurisprudence (fiqhal-muazanat), and the matter is related to the effect of balance jurisprudence in the ruling of lifting resuscitation devices from the brain dead, in which I first dealt whith what the balance jurisprudence is, by explaining the definition of the balance jurisprudence, its importance and its most important types, then secondly, I presented an explanation of the nature of brain death, and finally touched on the effect of balancing on the ruling on lifting resuscitation devices from the brain dead. The study concluded that the balance jurisprudence should be applied in cases of the brain dead to determine whether they need resuscitation devices or not.
