إختصاصات غرفة الإتهام في قانون الاجراءات الجزائية

Résumé: غرفة الاتهام هي من الغرف التي توجد على مستوى المجلس القضائي وهي بمثابة جهاز قضائي الذي جاء كضرورة يستدعيها الواقع و هي ضمان حقوق المتهمين، حيث قترن اسمها بأخطر قرار قضائي يمكن إصداره و المتمثل في توجيه الاتهام النهائي للمتهم في مواد الجنايات والذي لا يتماشى تماما مع اختصاصاته التي أناطها به المشرع، فهي تعد جهة قضائية لها اختصاصات متنوعة خلال مراحل الإجراءات الجزائية، وعلى مستوى التحقيق القضائي نجدها ادوار في غاية الأهمية، حيث تمكن الخصوم من حقهم في استئناف أوامر قاضي التحقيق، كما تعتبر في نفس الوقت جهة عليا للتحقيق، تصدر قرارات هامة بعد انتهاء التحقيق، كقرار بألا وجه للمتابعة و قرار الإحالة للمحكمة المختصة و قرار إبطال التحقيق، كما نلمس امتداد اختصاصات غرفة الاتهام خارج التحقيق القضائي، فهي جهة رقابة على الضبطية القضائية و تفصل في تنازع الاختصاص بين القضاة، كما يمتد دورها إلى مرحلة التنفيذ الجزائي وما بعدها عندما تفصل في إشكالات التنفيذ الجزائي و رد الاعتبار القضائي، و تفصل كذلك في رد الأشياء المحجوزة. الكلمات المفتاحية: غرفة الاتهام، الرقابة، استئناف أوامر قاضي التحقيق. Summary: The indictment chamber is one of the chambers that exists at the level of the Judicial Council and serves as a judicial organ, which came as a necessity called by reality, which is the guarantee of the rights of the accused, where its name was associated with the most serious judicial decision that can be issued, which is the final indictment of the accused in the articles of felonies, which is not fully in line with his terms of reference entrusted to him by the legislator, it is a judicial body with a variety of jurisdictions during the stages of criminal proceedings, and at the level of judicial investigation we find them roles of utmost importance, where it enables The opponents have the right to appeal the orders of the investigating judge, and at the same time considered a higher body of investigation, make important decisions after the end of the investigation, such as a decision not to face follow-up and the decision to refer to the competent court and the decision to annul the investigation, as we see the extension of the terms of reference of the indictment chamber outside the judicial investigation, it is a control body on judicial control and adjudicates the dispute of jurisdiction between judges, as well as its role extends to the stage of criminal execution and beyond when it decides on the problems of criminal execution and rehabilitation judicial, and also decides on the restitution of the seized items.
