حل المجالس الشعبية المحلية في النظام القانوني الجزائري

Résumé: تتمتع الجماعات الإقليمية في القانون الجزائري بالاستقلال عن السلطة الوصية، غير أن هذا الاستقلال يبقى محدودا بفعل خضوعها للرقابة الإدارية. وتشمل هذه الرقابة أشخاص و أعمال الجماعات الإقليمية، كما تمتد أيضا إلى هيئاتها التداولية وذلك من خلال إجراء الحل، الذي يعد من أخطر الوسائل الرقابية، التي تملكها السلطة المركزية في مواجهة المجالس الشعبية المحلية المنتخبة، والذي تتمكن من خلاله القضاء النهائي عليها. وبناءً على ما تقدم، نحاول من خلال هذا البحث تسليط الضوء على هذا الأسلوب الرقابي، وذلك بدراسة وتحليل كل قوانين الجماعات الإقليمية التي عرفتها الجزائر المتعلقة بموضوع الدراسة، بهدف الكشف عن تطور نظام الرقابة الإدارية على الهيئات التداولية بواسطة أسلوب الحل في القانون الجزائري، وأثره على استقلالها. Territorial collectivities in Algerian law are independent from the central authority, however this independence stays limited because it undergoes for the administrative control. This control includes persons and acts of the territorial collectivities, also it extends over to its deliberative organs across the dissolution procedure, which is one of the most dangerous control means, that the central authority have to confront the local elected people’s assemblies, which gives it the ability to eradicate it once and for all. Based on what is mentioned above, w’ill try to shed the light On this control mean throw this search by studying and analyzing all law Territorial collectivities that Algeria have ever known, that are related to the subject of this study, and discovering the development of the control system, which obligated on the deliberative organs throw the dissolution procedure in Algerian law and it effect on it independence.
