المساهمة الجزائية الأصلية بين قانون العقوبات الجزائري ونظام روما الأساسي

Résumé: يرتبط مفهوم الجريمة بالمساهمة الجزائية الاصلية، فلا جريمة دون فاعل على الاقل، ويستوي في ذلك الجريمة الوطنية في نظر قانون العقوبات الجزائري والجريمة الدولية بحسب نظام روما الأساسي ويعزز ذلك تبني نظام روما الأساسي لمبدأ التكامل بينه وبين القوانين الجزائية الوطنية ما يستوجب وجود توافق بينها في الأحكام العامة للمساهمة الجزائية الأصلية، وتتخذ هذه الأخيرة كأصل عام ثلاث صور هي الفاعل المادي الذي إما أن يكون منفردا أو مع فاعلين اخرين، والمحرض والفاعل المعنوي، ولكل من هذه الصور شروطها وأحكامها التي تتماشى مع طبيعتها ومع القانون الذي يحكمها بحسب الحالة ما إذا كانت الجريمة وطنية أو دولية. Abstract The concept of crime is linked to the original criminal contribution. There is at least no crime without an actor. In that regard, the Algerian Penal Code and the international criminal offence under the Rome Statute are the same. This is reinforced by the Rome Statute's adoption of the principle of complementarity with national penal laws. and the latter takes as a general origin three images: the physical actor who is either alone or with other actors, and the instigator and the moral actor, each of which has its own terms and conditions, which are consistent with their nature and with the law governing them, as the case may be, whether the offence is national or international.
