واقع المشاركة السياسية للمرأة الجزائرية وسبل تفعيلها على ضوء التجربة التونسية

Résumé: ملخص: تعتبر الجزائر من الدول العربية السباقة في اعتماد نظام الحصص النسائية (الكوطا) بعد التعديل الدستوري لعام 2008 وإصدار القانون العضوي رقم: 12-03 لعام 2012 تطبيقا لإلتزاماتها الدولية في هذا المجال، وهو ما أدى إلى زيادة معتبرة في نسب تمثيل المرأة في المجالس المنتخبة، غير أنه وككل الوثائق القانونية إحتوى القانون المشار إليه بعض النقائص التي يوعز إليها تقليص حظوظ المرأة في التمثيل النيابي وتولي مناصب صنع القرار السياسي. وفي المقابل تبنى المشرع التونسي بعد الثورة أقصى حدود التمثيل النسوي من خلال إعتماد مبدأ التناصف وقاعدة التناوب في تشكيل القوائم المترشحة. وسنحاول من خلال هذه الورقة تسليط الضوء على نظام الحصص المعتمد من طرف المشرع الجزائري آخذين بعين الاعتبار التجربة التونسية حتى نستطيع تقييم التجربة الجزائرية. Abstract: Algeria is one of the leading Arab countries in adopting the woman’s quota system -following the constitutional amendment of 2008 and the organic law number. 12-03 of 2012- in implementation of its international commitments in this field, which have led to a significant increase in the representation of women in elected councils. However, as in all legal documents, it had some shortcomings that have contributed to reducing women's chances of parliamentary representation and taking political decision-making positions. On the other hand, following the revolution, the Tunisian legislator adopted the maximum limits of women’s representation by reinforcing the principle of equality and the rule of rotation in the formation of candidate lists. In this paper, an attempt was made to suggest ways to improve the quota system adopted by the Algerian legislator in the light of the positive aspects of the Tunisian experience.
