الضوابط القانونية للهندسة الوراثية في التشريع الجزائري Legal Controls Of Genetic Engineering In Algerian Legislation

Résumé: تعتبر الهندسة الوراثية من التجارب الرائدة في عصرنا الحالي، وهي تختص بالجينات الحية، إذ تعمل على إنشاء كائنات حية وفق خصائص معينة وحسب الطلب ومنها الهندسة الوراثية البشرية التي تعمل على إيجاد أنسان خارق خال من الأمراض والعيوب ونظرا لأهميتها يسعى القانون على ضبطها وتنظيمها. ومنه تطرح الإشكالية التالية: إلى أي مدى يمكن للهندسة الوراثية أن تخل بالمبادئ العامة؟ وكيف للقانون أن ينظمها وما هي الضوابط القانونية لتنظيمها؟ للإجابة على هذه التساؤلات تطرق البحث للتعرف على الهندسة الوراثية ونشأتها, ودور القانون في ضبط تلك التجارب وتوجيهها حسب ما تخدم البشرية دون المساس بالمبادئ العامة وحرمة الجسم البشري. Enter Genetic engineering is the leading experiences of our time, which is concerned with living genes, serving for living organisms according to certain properties, including human genetic engineering, which is working to create a supernatural and disadvantage of diseases and given its importance. From it the following problem is raised: To what extent can genetic engineering be without general principles? How can the law regulate it and what are the legal controls to regulate it? To answer these questions discussed to identify genetic engineering and impact them, and the role of law in control and guidance of those experiences, as humanely serves without prejudice to general principles and human body
