القواعد الفقهيّة الضّابطة للرّخصة "جمعاً ودراسةً"

Résumé: هذه الدّراسة تهدف إلى سدّ ثغرة بحثيّة في المجال الفقهي، وذلك من خلال جمع القواعد الفقهيّة الضّابطة للرُّخصة والموجّهة للعمل بها، ومن ثَمّ الكشف عن حقيقة تلك القواعد، وبيان معانيها، وإبراز الأدلّة التي تستندُ إليها، مع التّعريج على بعضٍ من تطبيقاتها التي من شأنها أن تُعين القارئ على جودة فهمها، واتُّبع في سبيل الوصول إلى ذلك: المنهج الاستقرائيّ والمنهج التّحليليّ المُقارن؛ حيث عمدنا إلى استقراء غالب ما يتعلّق بالقواعد الفقهية الضّابطة للرّخصة، ومن ثَمّ قمنا بدراستها، وتحليلها، وذكر بعض التّطبيقات المُخرّجة عليها دراسةً فقهيّة مُقارنة باختصار يُناسب المقام. This study is an attempt to fill a research related gap in the Jurisprudential field through extrapolating the rules of concession from the foundational and jurisprudential sources and references, followed then by studying the rules concepts and evidences, in addition to a few related applications hoping so that it may help in clearing up the concept to the reader. And thus the methodologies adopted in this study were inductive and analytical in approach, as we worked on reading and extrapolating the rules of concession, which we then studied and analyzed, before mentioning few applications relevant to it.
