دور نظام التسليم المراقب في مكافحة جريمة الاتجار غير المشروع بالمخدرات

Résumé: الملخص: لقد شهد العالم في الآونة الأخيرة تطورا كبيرا في مجال ارتكاب الجريمة، خاصة الجرائم التي لها بعد دولي، والتي من بينها جريمة الاتجار غي المشروع في المخدرات، التي تعتبر شكل من أشكال الجريمة المنظمة، وبل أخطرها انتشارا، باعتبار أن آفة المخدرات أصبحت من الخطورة ما يهدد به مختلف دول العام مما جعلها مشكلة دولية، الأمر الذي جعل أغلب دول العالم تتجند من أجل مكافحة هذه الجريمة والتصدي لها في جميع مراحلها، والتي تبدأ من قبل أعمال الشرطة وإجراءاتها، وتستمر إلى ما بعد تنفيذ حكم القضاء، ومن أهم أساليب التعاون الدولي نجد أسلوب التسليم المراقب، هذا الأسلوب فرضته طبيعة التطورات على الساحة التقنية والعلمية، والانفتاح الذي عرفه العالم على مختلف الأصعدة إن التسليم المراقب كتقنية حديثة في مجال البحث والتحري، وجمع المعلومات والأدلة، قد أثبت فعاليته في الكشف وترقب المواد غير المشروعة خاصة المخدرات والمؤثرات العقلية، والمنظمات الإجرامية والقبض على المتورطين في الاتجار بهذه المواد، لهذا سوف نعالج في هذا البحث أسلوب التسليم المراقب من خلال تحديد مفهومه وطبيعته القانونية، والأحكام والضوابط التي يستند إليها، إضافة إلى تقييم هذا الأسلوب من خلال بيان أهميته ومدى فعاليته، ورصد أهم الصعوبات والمعوقات التي تواجهه في مكافحة جريمة الاتجار غير المشروع في المخدرات سواء على المستوى الوطني أو الدولي. Abstract: Recently, the world has experienced a high crime rate, including crimes with an international dimension as drug trafficking, which is a form of organized crime. even more, it has taken on a large scale. The drug has become an international problem, a scourge that seriously threatens the various states. This has pushed most countries to engage in the fight against this crime on all levels: from investigation and police procedures, to the implementation of judgments. Among the means of combating this crime, in the framework of international cooperation, we mention: the Controlled delivery, this method is dictated by the technical and scientific evolution and the openness of the world in differents areas. Controlled delivery is a modern technique in the field of research and investigation and information gathering, which has proven effective in the detection and anticipation of illicit substances , especially psychotropic drugs, as well as the fight against criminal organizations, with the aim of arresting those involved in the trafficking of these substances In this research, we will discuss the issue of supervised extradiction of criminals,by defining this concept and its legal nature, its bases, as well as the evaluation of this method by specifying its relevance and effectiveness, the difficulties and obstacles encountered. in the fight against the crime of drug trafficking, both nationally and internationally
