النظـام القضائي بالجزائر خلال العهد العثماني " استنطاق وتحليل عيّنة أرشيفية"

Résumé: عرفت مدينة الجزائرخلال العهد العثماني إزدواجية المذهب في النظام القضائي من خلال تعيين قضاة للمذهبين(الحنفي والمالكي) مع التركيزعلى تكوينهم العلمي وطبيعة القضايا المعروضة عليهم للنظر والبث فيها، بالإضافة إلى توقيعهم بالمحاكم الشرعية الحنفية والمالكية مع تحديد طرق وكيفيات تقاضي رواتبهم، لنخلص بعد ذلك إلى تحديد طبيعة العلاقة التي تربط القاضي بالفقيه ودوره في هيئة الإفتـاء من خلال وثائق المحاكم الشرعية بالمجلس العلمي. During the Ottoman era, the city of Algiers has known the duality of doctrine in the judicial system by appointing judges for the doctrines (Hanafi and Maliki) With a focus on their scientific composition and the nature of the cases submitted to them for consideration and broadcasting, in addition to their signature in the Shari'a courts of Hanafi and Maliki with the identification of ways and means of paying their salaries, we then conclude that the nature of the relationship between the judge and the jurist(fakih) and his role in the advisory body is determined through the Sharia Court Documents of the Scientific Council.
