المنافسة غير المشروعة في القانون الجزائري

Résumé: إن المعاملات التجارية في السوق تستند إلى مبادئ حرية المنافسة والشفافية بين الأعوان الاقتصاديين المتدخلين في العملية الاقتصادية، وفتح المجال أمامهم لاستقطاب اكبر عدد ممكن من الزبائن في ظل منافسة شريفة وحرة، ولكن سلوك أساليب غير مشروعة مخالفة لقانون الممارسات التجارية تجعل من العون الاقتصادي يرتكب مخالفات المنافسة غير المشروعة، يترتب عن ذلك حق الرجوع على المنافس مرتكب المخالفة من أجل مطالبته بالتعويض عن الأضرار، ذلك أن المنافسة غير المشروعة متى استوفت شروطها وتحققت، فإن المتسبب فيها يكون محل متابعة قضائية من خلال ما يعرف بدعوى المنافسة غير المشروعة، ولقمع هذه الأخيرة أقرّ المشرع الجزائري بمجموعة من الآليات القانونية، قصد توفير الحماية للفاعلين في السوق بما فيهم المستهلكين وهذا عن طريق ممارسة دعوى المنافسة غير المشروعة من جهة، أو باللجوء إلى مجلس المنافسة كسلطة وقائية وردعية من جهة أخرى. Abstract: Commercial transactions in the market are based on the principles of freedom of competition and transparency between the economic agents involved in the economic process, and open the way for them to attract the largest possible number of customers in light of fair and free competition, but the conduct of illegal methods contrary to the law of business practices make the economic aid commit violations of unfair competition, this entails the right of recourse to the competitor who committed the violation in order to claim compensation for damages, because when the illegal competition meets its conditions and is realized, the cause of it will be the subject of judicial prosecution through what is known as the claim of unfair competition, and to suppress the latter, the Algerian Legislature has adopted a set of legal mechanisms in order to provide protection to market players, including consumers, through the practice of unfair competition on the one hand, or by resorting to the competition Council as a preventive and deterrent authority on the other.
