التأصيل الإسلامي لمشكلات الأزواج-نشوز الزوجين أنموذجا-

Résumé: المشكلة الاجتماعية اختلال في توازن العلاقات الاجتماعية المتكافئة، وهو ما يشكل خطرا على السلم الاجتماعي، و عدم التعامل معها بطريقة صحيحة يؤدي إلى تفاقمها،فتصبح معضلة حقيقية تهدد بانهيار المجتمع، والمشاكل الزوجية من أخطرها لذا لابد من إيجاد منهج متكامل لحلها يقوم على تأصيل سليم، مع تضافر رؤى العلوم الإنسانية كلها لتقديم الحلول المناسبة لها, إن منهج الإسلام التأصيلي لمشاكل الأزواج يقوم على أمرين أساسيين:الأول سبل الوقاية، والثاني طرق العلاج. يعتبر الأساس الأول-سبل الوقاية- أمرا لازما ومحتما على الزوجين، فالزواج ميثاق غليظ، ورباط مقدس،ينبغي الإحاطة بشروطه، وأركانه، وغاياته، وتهيئة الزوجين نفسيا، واجتماعيا لإقامته، عن طريق دورات تعليمية،و تدريبية، يؤطرها مختصون في المجال الشرعي، والنفسي، والاجتماعي تفاديا لوقوع المشاكل أو الطلاق مستقبلا. أما الأساس الثاني-طرق العلاج- يلجأ إليه عند وقوع المشكلات، أو الخلاف، أو الشقاق بين الأزواج. و المُصطلح عليه في الشريعة الإسلامية بالنشوز، اللقائم على مراحل إصلاحية مبنية على الترتيب و التتابع، ينبغي مراعاتها دون إفراط أو تفريط، سواء تعلق الأمر بنشوز الزوج أو الزوجة. إن إصلاح مشكلات أو نشوز الأزواج من الدراسات الاجتماعية التي تتطلب جهودا كبيرة، وأبحاثا عميقة من جهات متعددة دينية، و نفسية، واجتماعية، و علمية، لكونها من القضايا الحساسة خصوصا في المجتمعات المسلمة التي تتميز بخصوصيات تفارق بها غيرها من المجتمعات. The social problem is an imbalance in equal social relations, which poses a threat to the social peace, and failure to deal with it in a correct manner leads to its exacerbation, so it becomes a real dilemma that threatens the collapse of society, and marital problems are among the most dangerous of them. Therefore, an integrated approach to solving them must be found based on legal rationale. With the collaboration of other human sciences visions to provide appropriate solutions. And Islam's method of establishing the problem of husbands stems from two basic things: the first is the means of prevention, and the second the methods of treatment. The first basis - the means of prevention - is considered an imperative and imperative matter for both spouses to take into account, for marriage is a tough charter and a sacred bond. And social to avoid problems or divorce in the future. The second basis - methods of treatment - resorted to when problems, disagreement, or discord between spouses. It was used in Sharia with the term disobedience, and the Shariah defined it in stages based on order and succession, which should be observed without excessive or negligence, whether the most important relates to the disobedience of the husband or wife.
