الأساس القانوني للتقاضي عن بعد ومتطلبات نجاحه دراسة تحليلية نقدية

Résumé: من المعلوم بأن التقاضي عن بعد يعتبر من بين أهم افرازات التطور التكنولوجي، والذي من أجل تفعيله وتجسيده على أرض الواقع فانه يتعين أن تتوافر جملة من المتطلبات لعل أهمها وجود أساس قانوني ينظم هذا الشكل من التقاضي، ناهيك عن ضرورة توفر الخبرة البشرية للقائمين عليه، وكذا الإمكانيات البشرية والفنية حتى يتم تمكين الأشخاص من القيام بكافة إجراءات التقاضي عن بعد دون الحاجة للانتقال إلى مقر المحكمة لرفع الدعوى وسداد رسومها، وحضور جلساتها بأنفسهم أو بواسطة وكلائهم. وسنحاول خلال دراستنا هذه بيان الأساس القانوني للتقاضي عن بعد، وأهم متطلبات تطبيقه من أجل تحقيق العدالة المرجوة سواء كانت هذه المتطلبات فنية أو تأهيلية. كلمات مفتاحية: أساس قانوني، تقاضي عن بعد-نجاح- متطلبات-عصرنة. Abstract: Remote litigation is one of the most important outcomes of technological development. Furthermore, the implementation of such a type of litigation involves a set of requirements that must be fulfilled. Mainly, remote litigation requires a legal basis to regulate it and people in charge need a certain amount of expertise. Moreover, to carry all litigation procedures remotely without the need to go to the court’s headquarters to file a lawsuit and pay the fees or the need to attend, in person, the sessions, remote litigation has to provide all of the necessary human and technical capabilities. In this paper, we will try to detail the legal basis for remote litigation and highlight the most important requirements, either technical or rehabilitative ones, for its implementation in order to achieve the desired justice. key words:Legal basis, remote litigation, success, requirements, modernization.
