الأحكام الموضوعية للجرائم الواقعة على الأصول

Résumé: يقصد بالجريمة ضد الأصول كل جريمة يرتكبها الفرع ضد أحد أصوله مهما علو، و تنقسم حسب التشريع الجزائري إلى قسمين، أولهما الجرائم ماسة بشخص الأصول التي تمس حياته و تتمثل في جريمة القتل، و التي تمس سلامته الجسدية وهي جريمة الضرب و الجرح و إعطاء مواد ضارة، أما القسم الثاني فهي جرائم الماسة بأموال الأصول وهي جريمة السرقة ضد الأصول و جريمة خيانة الأمانة و النصب على الأصول. و في هذا الصدد من الجرائم لعبت الرابطة الشرعية بين الأصل و فروعه دورا مهما في تقدير العقوبة، فجعلها المشرع ظرفا مشددا في الجرائم الماسة بشخص الأصول التي تنتهك حقه في الحياة و السلامة الجسدية و هي جرائم القتل و الضرب والجرح وإعطاء مواد ضارة ، كما كانت الرابطة الشرعية أيضا سببا في الإعفاء من العقاب و رفع الجزاء عن المتهم في الجرائم الواقعة على أموال الأصول كجريمة السرقة و جريمة خيانة الأمانة و النصب. The crime against parents means a crime committed by the son against one of his parents, no matter how high, and is divided according to Algerian legislation into two parts.
