تأثير علم الكلام في أصول الفقه عند الإمام الجويني (478 هـ): نقد تأثير نظرية الكسب الأشعرية في مباحث التكليف الأصولية أنموذجا The Impact Of Theology On The Principles Of Islamic Jurisprudence According To Imam Al Juwaini: A Critique Of The Influence Of The Ash'ari Kasb Theory On The Research Of Fundamentalist Accountability As An Example

Résumé: تهدف هذه الدراسة إلى رصد التعالق بين علمي أصول الفقه وأصول الدين (علم الكلام) في تراث أحد كبار الأصوليين المتكلمين وهو الإمام الجويني. فهذا الإمام الذي شكل مدرسة في النقد الكلامي والأصولي قد كانت له مراجعات في هذين المجالين المعرفيين أسهمت بشكل كبير في تطويرهما وإغناء مباحثهما. ومن بين تلك المراجعات نقده لنظرية الكسب، وهي نظرية الأشاعرة المركزية في الأفعال الإنسانية، وتبعا لذلك نقد ما بني عليها من الاختيارات والمباحث الأصولية. وقبل عرض ذلك النقد كان لا بد من إلقاء نظرة على تلك النظرية تهدف إلى التعريف بها وبأهم مرتكزاتها الأساسية ثم بيان أهم انسداداتها التي أدت بإمام الحرمين إلى ممارسة ذلك النقد. This study aims to monitor the relationship between the principles of jurisprudence and the principles of religion (theology) in the legacy of one of the major fundamentalist theologien, Imam AL JUWAINI. This imam, who found his own school of “theologien and fundamentalist criticism”, had revisions in these two cognitive areas which contributed massively into their development and enriched theirliterature. Among those revisions is his critique of the theory of “AL KASB” , which is the central theory of Ash'arism in explaining human actions, and accordingly his criticism of the underlying choices and “fundamentalist” research. However, before exploring AL JUWAINI’s criticism of AL KASB theory, we will have to take a look at this theory, its most important pillars, and then explain the most important flaws that led IMAM AL JUWAINI to come criticize it.
