الالتزام بالأمان فى المجال الطبى

Résumé: المستخلص لاتكفى الالتزامات القانونية المنصوص فى التشريعات المدنية والطبية فى مصر والامارات لتوفير الحماية للمرضى من أضرار المنتجات المعيبة أو الخطرة ، والتى تتمثل فى التزام المنتج بضمان العيوب الخفية لمنتجاته ، أو الالتزامات الأخرى والتى منها الالتزام بالاعلام ، الالتزام ببذل عناية ، والالتزام بتحقيق نتيجة ، والانتهاء بالالتزام بضمان السلامة ، نظرا لوجود مخاطر تلازم الادوية والأجهزة والمستلزمات الطبية ، سواء خطرة بطبيعتها أو بسبب استخدامها . وقد حاولت استخلاص التزام قانونى حديث يوفر الحماية اللازمة للمريض في المجال الطبى ، أطلقت عليه مصطلح الالتزام بالأمان ، ويعتبر هذا الالتزام من مستلزمات تنفيذ العقد ، ويقع على عاتق المنتج المتخصص باعتباره مدينا به أثناء تنفيذ العقد ، وقد تم اسنخلاصه من النصوص التشريعية الخاصة بالمنتجات المعيبة والاجتهادات الفقهية والأحكام القضائية . وتم التمييز بين الالتزام بالأمان والالتزامات الأخرى كالالتزام بالاعلام ، والالتزام بالنصيحة أو المشورة ، والالتزام بضمان السلامة ، وقمت بتحديد الأساس القانونى للالتزام بالأمان وطبيعته القانونية ، وقد خلصت الى خصوصية واستقلال هذا الالتزام عن غيره من هذه الالتزامات الأخرى، ولا يعتبر الالتزام بالأمان التزام عقدى ولكنه من مستلزمات تنفيذ العقد ، وطبيعته القانونية أنه التزام بتحقيق نتيجة مضمونها عدم تعريض حياة المرضى للخطر بسب استخدامهم الأدوية ، أو نتيجة استخدام الطبيب للاجهزة فى التشخيص أو العلاج . Abstract The legal obligations stipulated in the civil and medical legislation in Egypt and the UAE are not sufficient to provide protection to patients from the damage of defective or dangerous products, which is the obligation of the producer to ensure the hidden defects of his products or other obligations, including the obligation to inform, commitment to achieve a result, Safety, because of the risks associated with medicines, devices and medical supplies, both dangerous by nature or because of their use It has tried to draw up a modern legal commitment that provides the necessary protection for the patient in the medical field. The term "Medical Safety Commitment" has been defined as a commitment to the implementation of the contract and it is the responsibility of the specialized producer as a debtor during the execution of the contract. Jurisprudence and Judicial Judgments A distinction has been made between the obligation to safety and other obligations, such as the obligation to inform, comply with advice or advice, the obligation to ensure safety, and determine the legal basis for the obligation and legal nature of the obligation to be protected. And its legal nature is an obligation to achieve the result of its content not to endanger the lives of patients due to their use of drugs, or as a result of the physician's use of diagnostic or therapeutic equipment.
