الأساليب الديمقراطية في صياغة الدساتير - التجربة الجزائرية نموذجا -

Résumé: إن الأساليب الديمقراطية المعتمدة في وضع الدساتير تتمثل في كل من أسلوب الجمعية التأسيسية وأسلوب الاستفتاء الدستوري، ومن خلال هاذين الأسلوبين تتحقق فكرة مشاركة الشعب صاحب السيادة في صياغة أو تعديل الدستور. وقد عرفت الجزائر عدة دساتير عبر مراحل تاريخية وظروف معينة، والتي اختلفت في أساليب نشأتها وفي المبادئ التي نصت عليها، كان أولها دستور 1963 وأخرها دستور 1996 الذي لا يزال في تعديل مستمر إلى يومنا هذا. و خلصت الدراسة إلى جملة من النتائج أهمها، أن الاستفتاء يعتبر أسلوبا أكثر ديمقراطية، إضافة إلى أن تحقيق الديمقراطية الدستورية يكون نتيجة لمساهمة الشعب والمجتمع المدني في إعداد الدستور. The democratic methods adopted in drawing up constitutions are represented in both the method of the Constituent Assembly and the method of the constitutional referendum, and through these two methods the idea of the participation of the sovereign people in drafting or amending the constitution is realized. Algeria has known several constitutions through historical stages and specific circumstances, which differed in the methods of its inception and in the principles that were stipulated, the first of which was the constitution of 1963 and the last of which was the constitution of 1996, which is still in continuous amendment to this day. The study concluded with a set of results, the most important of which is that the referendum is considered a more democratic method, in addition to achieving constitutional democracy as a result of the people's and civil society’s participation in preparing the constitution.
