المسؤولية الدولية عن الإستعمار الإستيطاني الفرنسي في الجزائر

Résumé: تعتبر جرائم الإستعمار الإستيطاني الفرنسي بالجزائر، جرائم دولية بامتياز، وشهادات الجنرالات الفرنسية دليل قاطع على ذلك. وعليه، تثبت مسؤولية فرنسا بجانبيها المدني والجزائي، مما يفتح المجال أمام إمكانية محاكمتها سواء عن الجرائم المرتكبة خلال الحقبة الاستعمارية، أو الجرائم المستمرة، بما في ذلك قضيتي: التجارب النووية برقان، وخطي شال وموريس؛ طبقا لمبدأ عدم تقادم جرائم الحرب والجرائم ضد الإنسانية. وتبقى فرنسا إلى يومنا هذا، تتنصل من مسؤوليتها عن تعويض الضحايا، وترفض الإعتراف بجرائمها، خارقة بذلك قواعد القانون الدولي، بما في ذلك اتفاقيات جنيف الأربع لعام 1949. Abstract: French colonialism crims in Algeria are considered as international crimes, and the testimonies of the French generals are conclusive evidence of that. Accordingly, France's responsibility is proven in both its civil and penal aspects, which opens the way for the possibility of its prosecution, whether for crimes committed during the colonial era, or for ongoing crimes, including the two cases: the nuclear tests of regan, and the lines of Shal and Morris; In accordance with the principle of non-statute of limitations for war crimes and crimes against humanity. France continues to this day, avoiding its responsibility to compensate the victims, and refuses to admit its crimes, in violation of the rules of international law, including the four Geneva Conventions of 1949.
