Résumé: التجارة من أكثر القطاعات استجابة للتقدم التكنولوجي، وأوسعها إستخداما للتقنيات الحديثة والمتطورة، هذه الأخيرة تعد محور تحول تجاري، نتج عنه تغيّر عميق في سلوك المتعاملين و في قواعد المعاملات التجارية، حيث ظهر نوع جديد من المبادلات التجارية اصطلح عليه بالتجارة الإلكترونية، أفرزته شبكة التواصل الاجتماعي و وفرت له الوسائل الخاصة به والتي تتناسب مع طبيعته، وأضحت هذه الشبكة سوقا وطنية و دولية إفتراضية غير عادية، نظرا لما تمتاز به التجارة الإلكترونية من المردود الحسن والفعّال، واختصارا للوقت وتوفيرا في التكاليف. و من بين أدوات التجارة الإلكترونية تلك العقود التي تبرم عبر الوسائط الإلكترونية عن بعد، والتي تدعى بالعقود الإلكترونية وطرفاها هما المستهلك والمتدخل الإلكتروني. This network has become a national and international virtual market, In view of the good and effective benefits of e-commerce, shortening time and saving costs. Among the tools of e-commerce are those contracts that are concluded via electronic media remotely, which are called e-contracts and their parties are consumer and electronic intermediary.
