العوائق القانونية التي تواجه القاضي المدني للإصلاح الأضرار البيئية

Résumé: تهدف هذه الدراسة إلى الإحاطة بالصعوبات القانونية التي تواجه القاضي المدني في إصلاح الأضرار البيئية، سواء من الناحية الإجرائية أو الموضوعية المتمثلة في عدم فعالية دور الجمعيات البيئية في القيام بدورها القضائي امام القضاء المدني و عدم إعتماد المشرع مبدا التخصص في مجال المنازعات البيئية و تعذر على القاضي المدني تقدير تعويض الضرر البيئي الذي يخضع لأسس خاصة. خلصنا من خلال هذه الدراسة إلى ضرورة تبني النظام القانوني الخاص للتعويض عن الأضرار البيئية سواء من الناحية الإجرائية من خلال تمكين النيابة العامة صفة التقاضي في مجال المنازعات البيئية و إستحداث القضاء المتخصص في مجال المنازعات البيئية مع تبني أدلة الإثبات العلمية. Abstract: This study aims to be aware of the legal difficulties facing the civil judge in repairing environmental damages, both from a procedural or substantive point of view, represented inthe ineffectiveness of the role of environmental associations in performing their judicial role before the civil judiciary and the failure of the legislator to adopt the principle of specialization in the field of environmental disputes, and the judge was unable to Civil estimation of compensation for environmental damage which is subject to special grounds. Through this study, we concluded the necessity of adopting a special legal system for compensation for environmental damages, both from a procedural point of view, by enabling the Public Prosecution to litigate in the field of environmental disputes and creating a specialized judiciary in the field of environmental disputes with the adoption of scientific evidence
