Résumé: ملخص: يهدف الموضوع إلى تحديد الطبيعة القانونية لعقود الشراكة بين القطاع العام والشريك الأجنبي، والمنازعات الناشئة عنها وطبيعتها ونطاقها، وبيان دور القضاء الوطني وولايته في حسم تلك المنازعات، وقدرته في الموازنة بين مصالح طرفي النزاع، وبيان دور القضاء الدولي في منازعات عقود الشراكة بين القطاع العام بالدولة المضيفة والشريك الأجنبي، ومعرفة أهم القواعد الإجرائية والموضوعية التي تحكم حق التقاضي أمام جهات القضاء الدولي، للوقوف على مدى فعالية القضاء الدولي في حسم منازعات عقود الشراكة بين القطاع العام بالدولة المضيفة والشريك الأجنبي. وقد أبرزت الدراسة محدودية دور القضاء في حسم منازعات عقود الشراكة بين القطاع العام بالدولة المضيفة والشريك الأجنبي، وعدم فعاليتها، وهو ما يبرر رغبة الأطراف لحسم منازعاتها بالتحكيم. كلمات مفتاحية: عقود شراكة. قطاع عام. شريك أجنبي. قضاء دولي. حكم قضائي. Abstract: The role of the judiciary in resolving disputes between the host state's public sector and foreign partner is aimed at determining the legal nature of the public sector-foreign partner contracts, the nature and scope of disputes arising from them, the role and jurisdiction of the national judiciary in resolving such disputes, its ability to balance the interests of the parties to the dispute, the statement of the role of the international judiciary in disputes, the procedural and substantive rules governing the right to litigate before the international judiciary, and the effectiveness of the judiciary in resolving disputes of partnership contracts, basing on the analytical and comparative approaches of the parties to the dispute. The study highlighted the limited role of the judiciary in disputes between the public sector and foreign partner contracts.
