التزام البائع بالضمان في ضوء القانون المدني وقانون حماية المستهلك

Résumé: لقد أولى المشرع الجزائري أهمية كبيرة لموضوع الالتزام بالضمان، حيث اشتملت نصوص القانون المدن على قواعد منظمة لهذا الالتزام بغية تحقيق حماية مبررات اقتصادية وفنية. خاصة مع ما يشهده العصر الحالي من تقدم علمي وتكنولوجي واسعين، مما أثر لدرجة أن البائع المحترف (الذي تحول لمتدخل) أصبح يتفوق بدرايته على قدرات المستهلك. لذلك حاول المشرع توسيع مجال حماية الطرف الضعيف أي المستهلك وذلك عن طريق تمكينه ن الاستفادة من الضمان بقوة القانون، ولا يجوز الإنقاص منه أو إسقاطه، بل لإثباته، وهذا بحسب القانون 09-03 المتعلق بحماية المستهلك وقمع الغش. الكلمات المفتاحية: قانون حماية المستهلك، المشتري، المستهلك، المنتوجات، العيب الخفي، التعاقد. Abstract: The Algerian legislator attached great importance to the issue of the obligation to guarantee, as the provisions of the law included cities in order to achieve the protection of economic and technical justifications. Especially with the wide scientific and technological progress of the current era, which has affected the extent that the professional seller (who turned to an interventionist) is now outpacing the consumer's capabilities, so the legislator has tried to expand the protection of the weak party, i.e. the consumer, by enabling him to take advantage of the guarantee by the force of the law, and may not be reduced or dropped, but to prove it, according to law 09.03 on consumer protection and suppression of fraud.
