الــــــتــــــــــزام الادارة بمبــــــــــدأ الحيطــــــــــــــة في مجـــــــال الضبــــــــط البيئـــــي Administration Commitment To The Precautionary Principle In The Field Of Environmental Tuning

Résumé: يعد الضبط الإداري البيئي اهم ادوات الإدارة، لتجسيد حماية بيئية من أخطار التلوث، تنسجم مع التوجه الحديث لهذه الحماية، بانتهاج إجراءات تتطابق مع أهم المبادئ القانونية، مجسدة في مبدأ الحيطة، خاصة في ظل نقص المعارف العلمية وجسامة الاخطار البيئة . تمارس هذه الصلاحيات الرقابية الاستباقية من خلال أدوات تقنية وقانونية لتقييم الاثر البيئي للمشاريع، مجسدة في دراسة مدى التأثير،نظام الترخيص والإلزام في اطار احترام و تجسيد مبدأ الحيطة، مستعملة في ذلك اسلوب الخبرة و التجارب والاثبات المضاد لاعتماد المشاريع، ان الغاية المرجوة من الجدوى البيئية هي قياس درجة الحماية البيئية، من حدوث أي تدهور أو استنزاف للبيئة. Environmental management control is the most important tools of administration, to embody environmental protection from the dangers of pollution, consistent with the modern orientation of this protection, by adopting procedures that conform to the most important legal principles, embodied in the precautionary principle, especially in the light of the lack of scientific knowledge and the magnitude of environmental hazards. These proactive supervisory powers are exercised through technical and legal tools to assess the environmental impact of projects, embodied in the study of the extent of impact, licensing and binding system within the framework of respect and embodiment of the precautionary principle, using the method of experience, testing and proof of the project approval. The purpose of environmental feasibility is to measure the degree of environmental protection from any degradation or depletion of the environment.
