نسب ولد المتزوجة المغتصبة في التشريع الجزائري - دراسة مقارنة

Résumé: يعتبر نسب المولود للزوجين ثابت لهما، لأن الفراش الصحيح هو السبب الرئيسي لثبوت النسب. لكن قد يحصل أن تغتصب المرأة المتزوجة وينتج عن ذلك مولود، وبالتالي تعتبر مسألة تنسيبه للزوج أو للمغتصب أو تركه دون نسب أمرا مختلفا فيه شرعا. لأن بعض الفقهاء عالجوا مسألة الاغتصاب بنفس أحكام الزنا فيما يخص نسب الولد، وآخرون عالجوها بمعزل عنه، مجيزين تنسيب الولد للمغتصب. والمشرع الجزائري تطرق لهذه المسألة من خلال الاجتهاد القضائي، وجاء موقفه منحازا لمصلحة الطفل من خلال الاعتراف بنسبه للمغتصب، حماية لحقه في النسب، وتخفيفا للعبء عن المغتصبة، وتحميل المغتصب تبعات فعلته من نفقة ومصاريف وغيرها. لكنه لم يجد سندا لذلك غير إدراجه ضمن وطء الشبهة، بسبب تشابه الآثار لأن في كلا الحالتين يوجد ولد للمرأة من غير زوجها.
