العقود الذكية ودور القواعد الفقهية في تحكيمها
Résumé: هذا المقال الذي جاء بعنوان:" العقود الذكية ودور القواعد الفقهية في تحكيمها "، يتناول في طياته بيانا لنوع جديد من العقود والتي يطلق عليها العقود الذكية، وهي من العقود المستحدثة التي أثارت ضجة وانتشرت في العالم ككل، فصار لزاما بيان موقف الشريعة الإسلامية منها، وتهدف الدراسة في جانبها النظري إلى بيان المقصود من العقود الذكية و علاقتها بسسلة البلوكتشن والعملات الافتراضية، أما في الجانب التطبيقي فتهدف إلى بيان أهم القواعد الفقهية التي لها أثر في بناء حكم العقود الذكية. الكلمات المفتاحية: العقود الذكية؛ العملات الافتراضية؛ سلسلة البلوكتشين؛ القواعد الفقهية. This Article entitled:” the role of jurisprudence rules in smart contract arbitration” deals with a new type of contracts which is called “Smart Contracts”. Smart contracts is one of the innovated contracts that caused an uproar and spread throughout the hence, it became imperative to clarify the position of Islamic law from this type of contracts. In its theoretical aspect, this study aims to clarify the meaning of smart contracts and their relationship to the blockchain and cryptocurrencies. While on the practical side , it aims to explain the most important jurisprudential rules that have an impact on building the rules of smart contracts. Key words: The smart contracts; the cryptocurrencies, blockchain , the jurisprudential.
