التزامات المورد الإلكتروني في ظل قانون رقم 18_05 يتعلق بالتجارة الإلكترونية

Résumé: ملخص باللغة العربية: يعتبر عقد الاستهلاك من أكثر العقود تأثرا بتكنولوجيا الاتصالات، وأكثرها شيوعا التعاقد عبر شبكة الإنترنت الأمر الذي أدى بمعظم التشريعات إلى تنظيم مجال المعاملات الإلكترونية والأمر ذاته بالنسبة للمشرع الجزائري الذي أصدر قانون رقم 18_05، وحدد فيه التزامات طرفي عقد الاستهلاك الإلكتروني، إذ خص الفصل الخامس لالتزامات المورد الالكتروني منها ما هو مرتبط بالعقد وفقا لما هو متعارف عليه، ومنها ما تفرضه الطبيعة الإلكترونية للتعامل فيأخذ طابعا شكليا أو إجرائيا. Abstract: The consumer contract of consommation is considered to be one of the contracts most affected by communication technologies, and the most common is the contract via the Internet, which has led most legislations to regulate the field of electronic transactions, and so it is the same applies to the Algerian legislator who promulgated Law No. 05-18, in which it specifies the obligations of the parties to the electronic consumer contract. The fifth chapter is devoted to the obligations of the electronic supplier, some of which are linked to the contract depending on usage, and some of which are imposed by the electronic nature of the transaction, so it takes on a formal or procedural nature.
