ضوابط الترشح لعضوية المجالس المنتخبة في الجزائر على ضوء القانون العضوي رقم 21/01 المتعلق بالإنتخابات

Résumé: تهدف هذه الدراسة إلى تسليط الضوء على الشروط الواجب توافرها في المترشح لإكتساب صفة العضوية في المجالس المنتخبة سواء الوطنية منها أو المحلية، وذلك من خلال معالجة شروط ترتبط بالفرد ذاته من ناحية جنسيته وسنه وسمعته وغيرها يطلق عليها بالشروط الموضوعية. وأخرى تتعلق بالإجراءات التي يجب على كل من يرغب في أن يرشح نفسه للدخول في هذه العملية الإنتخابية أن يسلكها ويطلق عليها الشروط الشكلية الإجرائية على ضوء ما أقره القانون العضوي رقم 21/01 المتعلق بالإنتخابات من مستجدات بهذا الخصوص، بهدف ترقية فكرة المشاركة السياسية وتعميق مبادئ الديمقراطية من خلال تحسين وحماية مبدأ التمثيل من جهة، وتحقيق عملية انتخابية تعبر بصورة حقيقية وصادقة عن إرادة الناخبين من جهة أخرى. The purpose of this study is to highlight the conditions for candidates to become members of elected councils, whether national or local, by addressing conditions linked to the individual in terms of nationality, age, reputation and other so-called objective conditions. In addition, another one which is related to the procedures that anyone who wishes to stand for election to this electoral process must comply, and this is what we call procedural formality in the light of what is established by Organic Law No 21/01 on elections, aiming to promote the political participation idea and deepening democracy principles through the improvement and protection of the representation principle, on the one hand, and the achievement of an electoral process that truly and faithfully reflects the will of voters, on the other
