مدى فاعلية المحكمة الجنائية الدولية في حماية الاطفال من التجنيد أثناء النزاعات المسلحة
Résumé: يولي المجتمع الدولي اهتمام كبير لمسألة حماية الأطفال خلال النزاعات المسلحة وهذا نظرا لتفشي ظاهرة استخدامهم خلال مختلف الحروب التي شهدها العالم، وعلى هذا الأساس يكفل القانون الدولي الإنساني الحماية للأطفال خلال النزاعات المسلحة لأنها تعد انتهاكا لأحكامه وقواعده. لهذا الغرض، تم انشاء المحكمة الجنائية الدولية من أجل تطبيق قواعد القانون الدولي الإنساني عامة، وقواعد حماية الأطفال خلال النزاعات المسلحة خاصة، وهذا في ظل عدم وجود أجهزة فعالة تسهر على حمايتها. ونسعى من خلال هذه الورقة البحثية التعرف على الدور الذي تلعبه المحكمة الجنائية الدولية في قمع أعمال تجنيد الأطفال خلال النزاعات المسلحة ومدى فعاليتها في تحقيق ذلك. وقد توصلت الدراسة إلى أن المحكمة الجنائية الدولية لها دور كبير في مجال قمع أعمال تجنيد الأطفال أثناء النزاعات المسلحة، إلا أنها تصطدم بعدة عوائق وصعوبات تظهر من خلال التطبيق. The international community pays great attention to the issue of protecting children during armed conflicts due to the widespread phenomenon of their use during various witnessed wars. On this basis, the international humanitarian law guarantees protection for children during armed conflicts because it is a violation of its provisions and rules. For this purpose, the ICC was established in order to implement the rules of international humanitarian law in general, and the rules for the protection of children during armed conflicts in particular, in the absence of effective organs to protect them. Through this research paper, we seek to identify the role played by the International Criminal Court in suppressing the recruitment of children during armed conflicts and the extent of its effectiveness in achieving this goal. The study concluded that the International Criminal Court has a major role in suppressing the recruitment of children during armed conflicts, but it encounters several obstacles and difficulties that appear through the application.
