الحماية الجزائية للمياه و الأوساط المائية من التلوث في القانون الجزائري

Résumé: This study aims to highlight the role of penal protection for water and aquatic environments as an intrusive legal mechanism in protecting the water environment from various sources of pollution approved by the Algerian legislator according to a mixed legal approach. With the aim of providing direct and indirect penal protection for the aquatic environment, which contributes to the embodiment of the idea of an environmental criminal policy based on an environmental legal system, its features appear through the specificity of its legal rules, both the objective rule that determines the nature of crimes of water pollution and water environments and the scope of application of the penal responsibility resulting from them. or the procedural rule aimed at determining and approving the inspection and judicial follow-up procedures according to the nature of the persons doing so, In order to arrive at the sum of the consequences of applying the two rules together under the title of signing the environmental criminal penalty. This study showed the diversity of the efforts of the Algerian legislator in the field of penal protection of water and aquatic environments from pollution, but these efforts need to be activated in terms of inspection procedures and judicial follow-up of the crime of polluting water and aquatic environments, as well as in terms of the punitive system for this environmental crime, especially the penalty of environmental fine Daily and penalty work for the public good. تهدف هذه الدراسة الى ابراز دور الحماية الجزائية للمياه و الاوساط المائية كالية قانونية تدخلية في حماية الوسط المائي من مختلف مصادر التلوث التي اقرها المشرع الجزائري وفق منهج قانوني مختلط، و ذلك بهدف توفير حماية جزائية مباشرة و غير المباشر للوسط المائي، مما يساهم في تجسيد فكرة السياسة الجنائية البيئية القائمة على نظام قانوني بيئي، تظهر ملامحه من خلال خصوصية قواعده القانونية، سواء القاعدة الموضوعية التي تحدد طبيعة جرائم تلويث المياه و الاوساط المائية و نطاق تطبيق المسؤولية الجزائية المترتبة عنها، او القاعدة الاجرائية التي تهدف الى تحديد و اقرار اجراءات المعاينة و المتابعة القضائية لها حسب طبيعة الاشخاص القائمين بذلك، من اجل الوصول الى جملة النتائج المترتبة على تطبيق القاعدتين معا تحت عنوان توقيع الجزاء الجنائي البيئي. اظهرت هذه الدراسة تنوع جهود المشرع الجزائري في مجال الحماية الجزائية للمياه و الاوساط المائية من التلوث، غير ان هذه الجهود تحتاج الى تفعيل اكثر من حيث اجراءات المعاينة و المتابعة القضائية لجريمة تلويث المياه و الاوساط المائية و من حيث النظام العقابي لهذه الجريمة البيئية لاسيما عقوبة الغرامة البيئية اليومية و عقوبة العمل للمنفعة العامة.
