معالم منهج البحث الأصولي عند الفقيه محمد يحيى الولاتي المالكي رحمه الله (ت: 1330هـ/1912م).

Résumé: الملخص: تمثل الدراسات المنهجية الأصولية أحد جوانب الدراسات الشرعية المتعلقة بالقضايا المعاصرة، خاصة في عصرنا الذي تبحث فيه الأمة الإسلامية عن الأسباب التي حققت لها الأمجاد الفكرية، وأرست في غابر الزمن مقوماتها الحضارية؛ ووجه صلة الدراسات المنهجية الأصولية بالقضايا المعاصرة أنه لا يمكن لأي باحث في مجال القضايا المستجدة التصدر للكلام عنها دون الرجوع إلى علم الأصول، وهذا الرجوع يحتم عليه معرفة المعالم التي تميزت بها المناهج البحثية لأهل الأصول، ليقتبس من نور علمهم شعلة تضيء له دُجُنَّةَ فكره. وقد اخترت الفقيه محمد يحيى الولاتي المالكي ليكون نبراس هذا البحث وقطب رحاه، وقمت بتتبع واستخراج أهم المعالم العامة والخاصة التي ميزت منهج بحثه الأصولي، والتي يمكن من خلالها معرفة مدى نضجه الأصولي، وكذا الوقوف على طبيعة العقل الأصولي الذي خيم بظلاله على عصر الولاتي، والذي كان ـ بلا شك ـ مؤثرا على أحكام كثير من نوازل ذلك العصر.
