قراءة تحليلية للمرسوم التنفيذي 19-165 المحدد لكيفيات تقييم الموظف العام

Résumé: تطبيقا لأحكام المادة 103 من القانون الاساسي العام للوظيفة العمومية، صدر بعد مرور ثلاثة عشرة (13) سنة المرسوم التنفيذي رقم 19-165، المتضمن تحديد كيفيات تقييم الموظف العام، متضمنا بالإضافة إلى الأحكام العامة، ضوابط وقواعد التقييم لاسيما المعايير الموضوعية، وأهدافه ، بالإضافة إلى تحديد السلطة الإدارية المختصة بالتقييم والمتمثلة في السلطة الإدارية السلمية، التي تقيم الكفاءة المهنية للموظف وفق مناهج ملاءمة ، تعدها الإدارة بعد استشارة اللجان الإدارية المتساوية الاعضاء وموافقة السلطة المكلفة بالوظيفة العمومية. يملك المسؤول الإداري المختص بتقييم الموظف العام سلطة تقديرية في تقييم الموظف، إلا أنه لاحظنا قلة الضمانات التي أقرها المشرع الجزائري في القانون الأساسي العام للوظيفة العمومية والمرسوم التنفيذي رقم 19-165، مقارنة بنتائج التقييم وحجم الآثار الناتجة عن عملية التقييم. In accordance with the provisions of Article 103 of the General Basic Law on Public Service, 13 (13) years of executive decree No. 19-165 was issued, which includes the definition of the general employee's assessment methods, in addition to the general provisions, the rules and regulations, To determine the administrative authority concerned with evaluation, represented by the peaceful administrative authority, which assesses the professional competence of the employee according to suitable methods, prepared by the administration after consulting the equal administrative committees and the approval of the authority responsible for the public office. The administrative officer responsible for evaluating the public employee has discretion in evaluating the employee. However, we note the lack of guarantees approved by the Algerian legislator in the General Basic Law for Public Service and Executive Order No. 19-165, compared to the results of the evaluation and the impact of the evaluation process.
