.حقيقة شرع من قبلنا المعتبر في الاستدلال

Résumé: الملخص: يهدف هذا البحث للوصول إلى الحقيقة الاصطلاحيّة المعتبرة في الاستدلال بشرع من قبلنا عند علماء أصول الفقه، ويبتدأ ذلك ببيان التّعريف اللّغويّ والاصطلاحيّ للشّرع، والمعنى العامّ والخاصّ لشرع من قبلنا، ثمّ بعرض الخلاف مربوطاً بأدلّته في تعبّد النّبيّ صلّى الله عليه وسلّم قبل البعثة، وفي تعبّده وأُمّته بعد البعثة بشرع من قبلنا بغية تحرير محلّ النّزاع بدقّة في هذه المسألة؛ ليصل في الأخير إلى تحديد معنى جامع لشرع من قبلنا، وأنّه ليس معتبراً في الاستدلال على إطلاقه ولا مردوداً على إطلاقه، وأنّ المنسوخ منه ليس شرعاً لنا اتّفاقاً. Abstract: This research aims to reach the terminological truth that is considered in the inference of the char’a of who were before us among the scholars of Usul al-Fiqh, and that begins with the clarification of the linguistic and idiomatic definition of the Shar’a, and the general and private meaning of a char’a of who were before us, then the presentation of the disagreement linked to his evidence of the worship of the Prophet, "sala ellaho alih wsalam" before the mission, and his worship and his nation worship after the mission, by the char’a of who were before us in order to precisely liberate the subject of dispute in this topic; In the end, it reaches a definition of a comprehensive meaning of char’a of who were before us, and that it is not considered in the inference of its release nor a relevance to its launch, and that the canceled of it is not a char’a that we agree on.
