أنواع الترجيح بالقرائن

Résumé: الملخص : للقرينة دور مهم في الترجيح بين الأدلة التي يبدو في ظاهرها التعارض مع عدم إمكانية الجمع بينها؛ فالترجيح وظيفة من وظائف القرائن وأثر من آثارها، وإن القرائن المريحة كثيرة جدا، وتأخذ صورا عدة على ما ذكره الأصوليون في باب الترجيح، لكن سيتم الاقتصار على بعض الأمثلة بما يتضح به المقصود من البحث دون الاستقصاء، وذلك من خلال النوعين الآتيين: النوع الأول: الترجيح بالقرائن بين الأدلة الشرعية المتعارضة . النوع الثاني: الترجيح بالقرائن بين المعاني المحتملة للدليل الشرعي الواحد. لذلك كان هذا الموضوع المهم الذي يلفت النظر إلى أهمية الاعتماد على القرائن في الترجيح. Summary of the research The associated matter has an important role in preference among the evidences which appear ostensibly to be contradicted without the ability to join them with each other . Preference is a function of the associated matters' functions, and it is a mark of their marks. The preferred associated matters are very abundant . They take more forms than the forms mentioned by the source scholars in the preference chapter. But it will be contented with some examples which clarify the purpose of this research without examining them thoroughly.
